By completing and submitting a booking request/form to us, you agree to the terms and conditions set out below. We, us and ours as used herein refer to WALKAWAY.
TRIP DETAILS
The trip will be as described in the itinerary, which will be sent to you prior to booking. As we try our best to include as much detail as possible, this document may be subject to changes.
Minimum number or participants – Due to the nature of our trips, a minimum number of participants are required, and a trip will not be conducted unless the minimum number is secured 10 weeks prior to the start of the trip. We regret that we cannot accept responsibility for any other expenses you may have incurred in anticipation of the trip, including without limitation the purchase of non-refundable travel tickets. *In reality, confirmation of a trip will normally be much earlier than 10 weeks and once it is given will most likely not be revoked, even if the number of participants falls below the minimum number due to a late cancellation(s).
Details of trip – We will accept your booking when we receive your completed Booking Form and receive the deposit payable (as set out in the Section below), and will send you a Confirmation. The details of the trip will be as set out in the Confirmation, which will, together with these Terms and Conditions, form the agreement between us (the “Agreement”). Any capitalised term here will be as defined herein or in the Confirmation.
WALKWAY strives to maintain each trip as originally advertised. On occasion, conditions beyond our control may necessitate changes, modifications, or alterations to the trip itinerary; the substitution of accommodations; or the omission or substitution of specific advertised activities. WALKWAY may make such decisions in its sole discretion and is not responsible or liable for any expenses or losses that may result from those decisions. WALKWAY additionally reserves the right to restrict participation in any activity associated with the trip in the event it determines that participation may affect, impede, or endanger your welfare, or the welfare or enjoyment of another participant. We are not responsible for any losses or costs that may result from exercising this right.
BOOKING FORM
You book a trip by completing the Booking Form and returning it to us. If you are completing the Booking Form on behalf on another person, please ensure that you have his/her consent to disclose the information required in the Booking Form. By submitting a Booking Form on another person’s behalf, you warrant that you are authorised by such person(s) to make such a disclosure on his/her/their behalf. By submitting a Booking Form, you represent and warrant that the information set out therein is accurate and acknowledge that we will rely on such information to perform our agreement with you.
BOOKINGS: DEPOSIT, INFORMATION, DETAILS, PAYMENT
When you book a trip with us more than 60 days prior to the Departure Date of the Trip, a Deposit amounting to approximately 10% of the Trip Cost is payable on booking. This is refundable up to 60 days prior to the Departure Date on cancellation by either you or us. The remaining balance of 90% of the Cost is due to be paid 60 days prior to the Departure Date of the Trip. Failure to pay the balance within 10 days of its being due will be considered a cancellation by you, and the Cancellation terms set out below will apply.
If you book a trip with less than 30 days before the Departure Date of the Trip, 100% of the Cost will be due to be paid on booking.
If you are informed that a trip you have booked will not proceed on the intended Departure Date, you are entitled to a refund of the Deposit, which will be paid to you within 10 days (excluding Saturdays, Sundays and Italian banking holidays) of such notice via bank transfer to the same bank account that was used when the original payment was made and in the same currency that we originally received the funds.
[SURCHARGES] WHERE THE CURRENCY OF THE LOCATION OF THE TRIP IS NOT THE EURO (OUTSIDE THE EU)
Should there be an increase in exchange rate between the local currency of the destination and the EURO of more than [2]% from the rate of exchange as at the date stated in the Confirmation, we may have to adjust the pricing of the Trip. Should this happen, you will be informed of any extra charges payable, and if this results in an additional payment of 10% or more of the Trip Cost, you are entitled to cancel the Trip with a 100% refund.
CANCELLATIONS
Should you need to cancel a booking for a trip with us, the following terms apply:
All cancellations must be in writing by the person who paid the deposit. If a cancellation is made on behalf of another person named in the same Booking Form, you warrant that you are authorised to make such cancellation on his/her behalf. We will acknowledge your cancellation notice within 3 days, and once acknowledged, your notice is deemed effective on the date we received it, such date as indicated in our acknowledgement.
If you cancel a booking more than 60 days prior to the Departure Date of the Trip, 100% of the Deposit will be refunded to you.
If you cancel a booking between 60 to 45 days before the Departure Date of the Trip, your deposit will be forfeited.
If you cancel a booking between 44 and 31 days before the Departure Date of the Trip, 60% of the amount paid (which includes the Deposit and any further sums paid) will be forfeited (40% refund).
If you cancel a booking for a Trip 30 days or less before the Departure Date of the Trip, or after such Departure Date, 100% of the Trip Cost will be forfeited (0% refund).
We will do our best to ensure that the trips run as planned. However, unforeseen circumstances not within our control (including without limitation acts of war, terrorism, civil unrest, quarantine, curfew, natural disaster, pandemic, epidemic and other causes not within our control) can arise which might make it not advisable, difficult or not possible to operate our trips. In the event that we have to cancel a trip, we will give you a full refund of the amounts paid if this is more than 90 days prior to the Departure Date of the Trip. If we have to cancel a Trip less than 90 days prior to the Departure Date of the Trip, we will try our best to offer you comparable alternatives. If the alternatives are not acceptable to you, we will refund you the amounts paid after deduction of any reasonable expenses (if any).
ELIGIBILITY AND HEALTH
It is our fundamental objective that you enjoy your trip. As most of the activities on our trip require an adequate degree of physical fitness, please let us know if we can advise and assist you in choosing the trip that best suits your physical ability and interests. In order to do that please let us know if you have any have any physical or mental conditions that may need special requirements or attention. Please refer to our Privacy Policy on how we handle such information.
Please ensure that all persons named in the Booking Form(s) are able to meet the fitness level of the trip booked. WALKAWAY reserves the right to restrict participation in any activity associated with the trip in the event it determines that participation may affect, impede, or endanger one’s welfare, or the welfare and/or enjoyment of another participant. Bookings are accepted on the understanding that all persons travelling are normally in good health and physically equal to the minimum demands of the chosen trip.
Please ensure that you have received all appropriate or necessary vaccinations as required by your country(ies) of destination. Please consult your medical practitioner for advice.
INSURANCE
It is your responsibility to have adequate travel insurance that covers you for all eventualities on the Trip booked with us. Prior to the Departure Date, please provide us with details of your insurance together with proof of validity that it covers the entire duration of your Trip.
LIMITATION OF LIABILITY
To the fullest extent permitted by law, we expressly exclude all liabilities for any loss, damage or expense suffered or incurred in connection with or arising from any booking or trip with us except where such loss, damage and expense is caused by our gross negligence or wilful default.
We do not own or operate any entity which provides, or is to provide, goods or services for your Trip including, for example, lodging facilities, transportation companies, food service or entertainment providers (regardless of whether such activities are included as part of the your trip itinerary). As such, we are not liable for any negligent or wilful act or failure to act of any such third person, or of any other third party.
We will also not be liable for any for any injury, illness, death, loss, damage, expense cost or other claim of any description if it results from the acts and/or omissions of the person affected or force majeure, which are circumstances not within our control, including without limitation natural disasters and pandemics.
FORCE MAJEURE
Except as otherwise expressly stated in these Terms and Conditions, we will not accept liability or pay any compensation where the performance by us of our obligations under the Agreement is prevented, affected or made impracticable or impossible by any event or series of events in the nature of force majeure or, to the extent legally permitted, you otherwise suffer any damage, loss or expense of any nature as a result of such event or series of events.
PHOTOGRAPHS etc.
WALKAWAY reserves the right to take photographic or film records of any of its tours, and to use any such photographic or film records for promotional and/or commercial purposes.
GOVERNING LAW
The Agreement between us and these terms and conditions are governed by the laws of the Italian Republic.
